Booking

To book our villa please send an e-mail to info@topfloridavilla.co.uk stating the arrival and departure dates you wish to book together with your name and contact details. We shall then send a booking form via e-mail. The booking form is to be returned within 7 days along with your booking deposit or full amount if traveling within 8 weeks of departure. A booking between the owners and the person(s) making the booking is valid only after the booking form has been completed, signed and the appropriate deposit has been paid to the owners and the booking has then been confirmed in writing to the party leader by the owners. The cost of your villa will be confirmed at time of booking. We reserve the right to increase/decrease the advertised price of the villa at any time, however once your reservation has been confirmed any future increases in costs will not be applied to your booking.

Payment

A deposit of 100/$160 per week is required at the time of booking. Once accepted, the deposit is non refundable. The remaining balance is to be paid no later than 8 weeks before travel. We reserve the right to cancel the booking if the balance is not received by this date and the deposit will forfeited.

Contract

Signing of the booking form constitutes acceptance of these terms and conditions by all members of your party. The party leader must be at least 18 years of age. You must be authorised by all persons on your holiday confirmation to make the booking, including those guests added at a later date. You must consent to our processing personal information about you and other members of your party.

Security Deposit

A security deposit of 250/$ 400 will be required, either via a credit card or personal cheque when you pay your balance. Any security deposit held by us will not be banked unless loss or damage occurs. Subject to there being no loss or damage your security deposit will be refunded in full. A full inventory check is done by our Management Company immediately before your arrival and after your departure. On your arrival, it is in your party’s interest to check your villa. If any damage/breakages are found, please contact the Management Company immediately. After occupying the villa for 48 hours the above will be void and you will be liable. If damage is found after your departure, the costs incurred for replacement or repair will be charged to against your security deposit.

Safety & Security

Under the terms of the Florida State licensing laws, the door to the pool area is alarmed for protection of children and as a reminder to keep the door closed for air conditioning to work effectively and prevent damage. The door alarm should not be tampered with. A fine will be imposed if this rule is ignored. Whilst occupying the villa you must take all reasonable responsibility for the safety and security of your personal possessions and of the property. All exits must be secured each time you leave the property.

Liability

The owners and the Management Company of this property accept no responsibility whatsoever for death, personal injury, loss or damage to persons or personal effects, however caused. The use of accommodation and its amenities is entirely at your own risk. We strongly recommend you take out your own insurance.

Arrival & Departure

The property will be available for occupancy from 4pm on the day of arrival and is to be vacated by 10am prompt on day of departure to enable cleaning of the villa to be completed prior to arrival of new guests. Early or late checkout is available, subject to availability and is at the discretion of the owner and/or Management Company. A fee will apply for an early check-in or late checkout.

Cancellations

You may cancel your booking at any time by providing the owners with written notice of cancellation. E-mail cancellations are not acceptable. Cancellation charges are as follows: If cancelled up to 8 weeks before arrival, only deposit is forfeited. If cancelled within 6 - 8 weeks of arrival then 50% of the total booking cost will be forfeited. Within 4 - 6 weeks of arrival 75% of the total booking cost will be forfeited. If cancelled within 4 weeks of arrival the full rental payment will be forfeited. We strongly advise that all guests ensure cancellation cover is provided for within their travel insurance policy.

Force Majeure

We reserve the right to cancel any booking, if due to unforeseen circumstances the home is unavailable for booking for whatever reason. The owner, through our Management Company will endeavour to find a similar standard home. If this is this is not acceptable to your party, then all money paid will be refunded without interest or compensation. We cannot be held responsible for or liable in respect of loss, damage or changes caused by force majeure. Including, but not limited to strikes, flood, airport closure, weather conditions or other events beyond our control.

Swimming Pool

Should your party be unable to use the villa swimming pool due to repair or maintenance for a period in excess of 7 days, a partial refund will be made at the owners discretion for each day the pool is unusable. Guests are forbidden to allow children to use the pool without adult supervision. If guests have paid for pool heat, please be aware that we cannot guarantee the temperature of the pool, as this will vary according to several factors, the main one being outside air temperature. A pool blanket is supplied and should be used in conjunction with pool heat.

Smoking & Pets

For the safety and comfort of all our guests smoking is not permitted inside the house. You are welcome to smoke outside on the pool deck. No pets are allowed on the premises.

Law

This contract is subject to and shall be interpreted in accordance with the laws of England and all parties hereby submit to the exclusive jurisdiction of the English courts.
